VENDOR AGREEMENT 2026

The following agreement outlines the business relationship between the business or persons renting display space as a “Vendor” at Colt’s Nursery Inc. DBA Patio Gardens’ Harvest Market (6536 West Saanich Rd, Saanichton, BC V8M 1W8), hereby referred to as “Patio Gardens,” on Saturday, October 17th, 2026 (10:00 AM – 5:00 PM).


SPACE RENTAL PAYMENT

Successful Vendors will receive a letter of acceptance via email, along with a link for payment. If an application is not accepted, notification will also be sent by email.

Patio Gardens reserves the right to approve or decline any application at its discretion. A completed application form is required for all vendors.

Payment is due in full upon acceptance. Rental space is not guaranteed until payment has been received.


CANCELLATION POLICY

If Patio Gardens needs to cancel the Market for any reason, vendors will receive a full refund.

Vendors who wish to cancel their space will receive a full refund if written notice is provided to Patio Gardens by 5:00 PM on September 17th, 2026. No refunds will be issued for cancellations made after this date.


SUBLETTING / SHARED SPACE

Subletting space is prohibited. The Vendor shall not assign, sublet, or share all or any part of the space allocated by Patio Gardens.


EXHIBIT SPACE INFORMATION

Patio Gardens will provide tables, chairs, power (if requested and approved), and wall space (if applicable) at its discretion. Vendors are responsible for providing their own table linens, signage, and additional décor. Setup and takedown of the exhibit space is the sole responsibility of the Vendor.

All products, displays, and signage must fit within the dimensions of the table rented and must not exceed 8 feet in height. Nothing may extend beyond the assigned space, including into aisles or neighbouring vendor areas, to ensure safe traffic flow throughout the market.

Displays must not obstruct the view of adjacent tables. If your display exceeds 8 feet in height or has special spatial requirements, you must notify Patio Gardens at the time of application for approval.

Vendors may not attach signage, shelving, or décor to walls, ceilings, or structural supports unless permission has been granted in advance.

All vendors are expected to confine all materials and activities to their assigned space and remain considerate of neighbouring vendors.


ASSIGNMENT OF EXHIBIT SPACE

Exhibit space will be allocated by Patio Gardens. Patio Gardens reserves the right to relocate exhibits due to floor plan adjustments or in the interest of traffic flow and vendor exposure.

Patio Gardens will not be held liable if competing vendors are placed adjacent to or near each other, though efforts will be made to ensure fair placement where possible. No major changes to displays are permitted during public market hours.


SECURITY

Patio Gardens is not responsible for any loss or damage resulting from booths being unattended during setup, market hours, or takedown.

All products and displays are left on site at the sole risk of the Vendor. Patio Gardens is not responsible for lost, stolen, or damaged goods.

Vendors are strongly advised not to leave their booth unattended during market hours. Displays should be secured or covered during non-show hours, and all cash boxes, perishables, and sensitive items should be removed daily.


SET-UP / TAKE DOWN

All vendors must be set up during the designated time: Friday, October 16th, 2026 (10:00 AM – 4:00 PM). Please unload promptly and move vehicles to designated parking areas as quickly as possible.

Vendors will also have access for final setup prior to opening on Saturday, October 17th, 2026 from 8:00 AM – 9:30 AM, with all vehicles removed from the main Patio Gardens parking lot by no later than 9:00 AM.

Take down may not begin until after 5:00 PM on Saturday, October 17th, 2026. All displays must be fully removed by 7:00 PM on Saturday, October 17th, 2026.


CHARACTER AND CONDUCT

All displays and promotional materials must be presented in good taste and in a professional manner. Interactions with customers, other vendors, and staff must remain respectful at all times.

Abusive or disruptive behaviour will not be tolerated and may result in removal from the premises without refund, at the discretion of management.


FOOD

Vendors providing food or beverage items must comply with all applicable Public Health regulations and may be subject to inspection during the event.

Vendors must indicate food sampling or sales on their application. Patio Gardens reserves the right to cease any sampling or sales that do not meet regulations.


SAMPLES, RAFFLES, DRAWS, ALCOHOL

Free samples may be distributed.

Alcohol is strictly prohibited from being served, sold, or distributed in any form.


NOISE

The Vendor shall cease any use of loudspeakers, microphones, amplifiers, or other audio equipment upon request from Patio Gardens.

Patio Gardens may provide background music during the market, and vendor activity must not interfere with it.


CARE

Vendors are responsible for keeping their space clean and organized throughout the event.

Spaces must be ready for opening at the start of the market. All garbage must be disposed of in designated bins, and cardboard must be placed in the cardboard recycling area.

Failure to leave the space clean may result in cleaning charges.


LIABILITY

Patio Gardens shall not be liable for any loss, damage, theft, or destruction of goods or property belonging to the Vendor.

Patio Gardens shall not be responsible for any injury, damage, or costs incurred by the Vendor, their staff, or agents.

Patio Gardens shall not be responsible for losses due to changes, delays, or cancellation of the event.


PARKING

Parking is extremely limited on site. Vendors are encouraged to be dropped off or park off-site where possible to prioritize customer access.

During market hours, no vehicles are permitted to stop or park in front of Patio Gardens for any reason.

Vendors must park only in designated areas or off-site as directed by staff. Unauthorized vehicles may be towed at the owner’s expense.


GENERAL

All matters not covered by these Terms and Conditions are subject to the decision of Patio Gardens.

Patio Gardens reserves full discretion in interpreting and enforcing these terms and may amend rules as necessary for the successful operation of the market.

Vendors agree to comply with all decisions made by Patio Gardens.


SALES DISCLAIMER AND EXPENSES

Participation in the Market does not guarantee any level of sales, traffic, or revenue.

Patio Gardens is not responsible for financial outcomes, including lost revenue or vendor expenses.

Vendors are solely responsible for all business costs, including setup, staffing, supplies, transportation, permits, insurance, and licenses.

By submitting the Patio Gardens Harvest Market Vendor Application, you agree to these Terms and Conditions.
